[Zoning Applications Photo] Each municipality has a different application process for their respective zoning and planning boards. All processes, however, must conform to the requirements of the New Jersey Statutes. Here is a copy of Hoboken's current zoning application as of July 2006. As you can see, it is a detailed document that requires information as well as under oath certifications.

Generally speaking, a person seeking a zoning variance or unique conditional use needs to have a survey, architectural plans, a written application, and a payment fee. Since an escrow for paying the experts that the city hires to review the zoning request is included, the fee normally costs more than you would think.

In Hoboken, we are lucky to have a very professional Zoning and Planning Office. The problem is that the overwhelming amount of applications can cause delays, and it can take up to five months before an applicant is allowed to appear before the Board for the first time. After the first hearing, there can be other delays and scheduling conflicts, and it can take three to four months before the Board is able to vote on an application.

Generally speaking, there must be a reason for a variance request to be granted, and there are deadlines and notice requirements to consider. The entire process can be confusing to a novice.
